Terms of Use

These Terms of Use (“Terms”) apply to your use of the ItsRecord iOS application (“ItsRecord” or the “App”) and related ItsRecord website. The App is provided by owned by WEN YUN NIU (“we,” “us,” or “our”).

1. About ItsRecord

ItsRecord is a record-keeping and organizational tool designed to help users capture and organize receipts, expenses, purchased items, inventory information, and related records.

ItsRecord is not an accounting, tax, legal, financial, or professional advisory service. Information generated, organized, calculated, or displayed by the App is provided for record-keeping and informational purposes only.

2. Lawful Use

You may use ItsRecord only for lawful purposes and in accordance with these Terms and applicable law. You are responsible for how you use information stored, generated, exported, or organized through the App.

3. Your Records and Content

You retain ownership of the receipts, images, records, notes, and other content you create, import, or enter into ItsRecord. You are responsible for the accuracy, completeness, and legality of the information you enter or maintain in the App.

ItsRecord is a record-keeping tool and does not independently verify the accuracy or authenticity of your records.

4. Local Storage and Backups

ItsRecord stores your App records locally on your iPhone by default. Backup is optional. If you enable the backup feature, you select a supported cloud-backed storage location through Apple’s Files interface.

After a supported backup location is selected, backups may be created automatically according to the schedule you choose, and you may also create a backup manually. You are responsible for maintaining backups of information that is important to you and for verifying that your backups are available when needed.

Deleting ItsRecord removes data stored in the App’s private local storage on that iPhone. We strongly recommend maintaining a current backup before deleting the App or replacing your device.

5. Third-Party Storage Services

If you choose a third-party storage provider through Apple’s Files interface, your use of that service is subject to the provider’s own terms, policies, availability, and security practices. We do not control third-party storage providers and are not responsible for their operation, availability, changes, or discontinuation.

6. Business and Tax Records

ItsRecord may help you organize receipts and expense information that may be useful for personal, business, bookkeeping, or tax-related purposes.

However, ItsRecord does not determine whether an expense is deductible, whether a record satisfies the requirements of the Canada Revenue Agency or another authority, or whether information is sufficient for accounting, tax, audit, or legal purposes. You remain responsible for determining what records you are required to maintain and for obtaining professional advice when appropriate.

7. App Store Licence and Apple Terms

ItsRecord is distributed through the Apple App Store. Unless a separate Custom EULA is expressly provided for the App, your licence to use ItsRecord is governed by Apple’s applicable Standard Licensed Application End User License Agreement (Standard EULA) and Apple’s applicable Usage Rules, in addition to these Terms.

These Terms do not create a separate device-count licence or override rights granted under Apple’s applicable Standard EULA or Usage Rules.

8. Intellectual Property

The ItsRecord software, source code, user interface, website content, graphics, documentation, the ItsRecord trademark, and other original materials are owned by WEN YUN NIU or, where applicable, used under licence, and are protected by applicable copyright, trademark, and other intellectual property laws.

Your purchase or use of ItsRecord does not transfer to you ownership of the App, the ItsRecord trademark, source code, website, or other intellectual property. Nothing in these Terms restricts rights that cannot lawfully be restricted.

9. Purchases and Refunds

ItsRecord is currently offered as a one-time paid download through the Apple App Store. ItsRecord does not currently require a subscription or offer in-app purchases.

Payments for the App are processed by Apple. Refund requests are handled through Apple in accordance with Apple’s applicable policies and applicable law.

Changing the price of ItsRecord for future purchasers does not by itself create an additional charge for users who have already purchased the App.

10. Updates and Changes to the App

We may provide updates, improvements, bug fixes, compatibility changes, or new features from time to time. We may also modify, replace, add, or discontinue features where reasonably necessary, subject to applicable law.

These Terms do not guarantee that every existing feature will remain available indefinitely or that every future product, service, feature, or major release will be provided without additional charge.

11. Availability and Compatibility

We do not guarantee that ItsRecord will be error-free or remain compatible with every future device, iOS version, third-party storage provider, or system service. We may discontinue distribution or support of the App in the future, subject to applicable law.

12. Disclaimer

To the maximum extent permitted by applicable law, ItsRecord is provided on an “as is” and “as available” basis. We do not guarantee that OCR results, calculations, records, backups, exports, or other App output will always be accurate, complete, available, or recoverable.

You should review important records and maintain appropriate backups. Nothing in these Terms excludes warranties, conditions, rights, or remedies that cannot lawfully be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the App provider and applicable rights holders will not be liable for indirect, incidental, special, or consequential loss arising from your use of or inability to use ItsRecord, including loss arising from deletion of locally stored data, unavailable or incomplete backups, device failure, third-party storage services, or changes to iOS or related system services.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under applicable law.

14. Stopping Use and Discontinuation

You may stop using ItsRecord at any time by deleting the App from your device. We may discontinue future distribution, development, or support of the App, subject to applicable law.

15. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on the ItsRecord website with an updated “Last updated” date.

Where appropriate, material changes may also be communicated through the App or its App Store listing. Because ItsRecord does not require user registration, we do not maintain an email list of all App users for the purpose of sending Terms notices.

16. Governing Law

These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without limiting any mandatory rights you may have under applicable consumer protection law.

17. Consumer Rights

Nothing in these Terms limits, waives, or excludes any right or remedy available to you under applicable consumer protection or other laws where that right or remedy cannot lawfully be limited, waived, or excluded.
